What to do if a company goes bust Sample letters

Use these sample letters to make a complaint. You can adapt the text of them if you are making your complaint by email or through the company's website.

To notify ATOL about a claim for a holiday from a company that has gone bust:

On (date) I purchased (give details of flights or holiday) from the above company. I paid (£xxxx) to as payment. I have just discovered that the company has gone into receivership.

Under the Package Travel, Package Holiday and Package Tours Regulations 1992 I believe that I am protected by Atol in this instance and entitled to a refund. I would therefore like to submit a claim for the (£xx) that I paid. Please find enclosed copies of my receipt(s) in support of my claim.

To claim compensation from your credit card company for goods not delivered by a company that has gone bust:

On (date) I paid for (goods/ service) with the above credit card. Since then (xx company) that I bought the (goods/ service) from has been declared bankrupt, and the goods I ordered have not been delivered.

Under Section 75 of the Consumer Credit Act 1974 I am entitled to make a claim against you for any losses incurred.

I enclose a receipt for the goods and look forward to hearing from you regarding a full refund. If you should require any further information please let me know.
