Letter to make ‘time of the essence’ on a pushchair

Dear Sir/Madam

Ref: [order number]

On [insert date] I came into your shop and placed an order for a [insert make and model] pushchair, which I paid for in advance.

I was told at the time that I could expect the pushchair within two weeks of placing the order. The pushchair has still not been delivered.

Under the Consumer Rights Act you are required to deliver the pushchair to me within 30 days.

As [insert number of days/weeks] have elapsed since I placed the order, you have failed to fulfil this statutory requirement and are therefore in breach of contract.

I am now making time of the essence. 

If you do not send me the pushchair within seven days, I will consider our contract at an end, as I am entitled to do in law. 

I will then expect you to refund the full purchase price of [£xx] to me.

Should it then cost me more to obtain an identical pushchair elsewhere, I will be looking to you to refund the difference as I am legally entitled to do.
